Terms and conditions of the Delices Low Carb website specializing in the sale of sugar-free products

Hereinafter referred to as: “the Seller”
ON THE ONE HAND
AND any person placing an order via the website: www.deliceslowcarb.com: "the Site"
Hereinafter referred to as "the Buyer" or "the Customer"
ON THE OTHER HAND
Which have previously stated the following:
These General Terms and Conditions of Sale: "GTC" apply to any order placed on the Site. The relationship between the Seller and the Buyer is exclusively governed by these GTC, excluding any other condition or document of any kind.
The Seller reserves the right to adapt or modify these at any time. Where applicable, the new T&Cs will be those in effect on the day of the order.
Furthermore, placing an order on the Site directly implies the Buyer's acceptance of these General Terms and Conditions without any reservation.
This being stated, he moved on to the subject of this contract:
1/ Orders
Orders placed on the Site are recorded upon validation of the order by the Buyer, this will be made final when it has been confirmed by our company to the email address that the Customer has communicated. After validation and payment of the full price, no order may be modified in any way whatsoever. This validation will be due to the acceptance of these General Terms and Conditions and the waiver of the right to rely on one's own conditions of purchase or other provisions.
SARL REGIME CRETOIS also reserves the right to cancel or refuse any order from a Customer with whom a dispute relating to the payment of a previous order is in progress or for other contentious reasons.
2/ Availability of products and quantity ordered
The products and baskets sold on the Site are those visible on www.deliceslowcarb.com within the limits of available stocks. In the event of temporary unavailability, the company REGIME CRETOIS specializing in the sale of sugar-free products reserves the right to process the order with an additional one-week delay.
The unavailability of products is indicated on the Site. If the unavailability occurs after the Buyer has placed the order, the Buyer will be informed by email or telephone of the products that are out of stock. The Buyer will then have one working week (excluding weekends and public holidays) to request the cancellation or exchange of the order by contacting Customer Service. (9). After this period, without a response from the Buyer, the order will be sent to the Buyer with the available items and only these will of course be billed to the Buyer. The refund of an order canceled by the Buyer due to out of stock items will be made by credit to the Customer's bank account or by bank check addressed to the Customer's name at the billing address within 30 days of payment of the price.
3/ Price
The prices of the products on our Site are indicated in euros including tax, governed by article 293 B of the General Tax Code. They include VAT, handling, packaging and storage costs for sugar-free products. They do not include shipping and delivery costs.
REGIME CRETOIS reserves the right to modify its prices at any time, it being understood that the products will be invoiced on the basis of the prices in effect at the time the orders are recorded.
4/ Delivery
a/ General
Orders placed on the Site: www.deliceslowcarb.com are delivered to the address provided by the Buyer when ordering or to a relay point if that was their choice.
The Buyer is required to implement all necessary due diligence for the proper delivery of his order, namely providing all the information essential for delivery (accuracy of the address, etc.). In the event of an incorrect or incomplete address, the return shipping costs will be borne by the Buyer. Failing this, REGIME CRETOIS cannot under any circumstances be held responsible for a failure to deliver its sugar-free products. In the event of damage occurring during transport, the claim must be made to the carrier within 3 days of delivery.
Various carriers are available to deliver your package. The delivery time varies between the order and receipt of the package depending on the selected delivery person (1 to 11 days). Any possible delay in delivery times provided by the carriers will not give rise to damages, retention or cancellation of the order. In the event of the Buyer's absence on the day of delivery, the carrier will leave a notice in the mailbox indicating the place and date on which he can collect his package. Any delays cannot be attributed to our Company, which declines all responsibility for the time taken by the Buyer to collect his package. No damages may be claimed. These aforementioned delays do not, moreover, give the Buyer the right to cancel the sale or refuse the goods.
b/ Prices
For any order, the Buyer must pay shipping costs which vary depending on the carrier chosen:
In mainland France:
- With DPD Predict home delivery by appointment (24-48h home delivery in the time slot that suits you best once the order is in "shipped" status (among the choices offered by DPD).)
Single rate €6 incl. VAT
- With DPD Delivery to Pickup relay (24-48h delivery in France to more than 5000 Pickup relays once the order is in the "shipped" status)
Single rate: €4.60 incl. VAT
In Switzerland:
- DPD international delivery:
Single rate: €19.20 incl. VAT
- UPS international:
Single rate: €26.40 incl. VAT
In the European Union:
- International delivery by DPD:
Single rate: €6.60
- Colissimo international without signature:
Single rate: €9.60 incl. VAT
DOM/Antilles:
By Colissimo without signature (Access):
- less than 3 kg: €30
- more than 3 kg: €45
c/ Deadlines
Orders placed Monday to Friday before noon are prepared on D+1. Those placed after noon will be processed on D+2.
Orders placed on Saturday or Sunday will be processed the following Monday. If placed on a public holiday, they will be processed the following business day.
Once the package is in the "shipped" state, the delivery time depending on the choice of carrier starts. (see section b)
d/ In case of a problem with delivery
When the package is handed over by the carrier (or collected from a relay point), the Buyer must check the condition of the packaging and the conformity of their order. For any complaint regarding any possible non-conformity, the Buyer must notify the Company's Customer Service by post or email within 72 hours of receiving the package.
For any complaint regarding apparent defects concerning the sale of sugar-free products, a registered letter with acknowledgment of receipt must be sent to us within 8 days of receipt. If the complaint is accepted by SARL REGIME CRETOIS, the Buyer may be reimbursed for the products ordered.
Outside of the aforementioned deadlines, the order will be deemed accepted and the products compliant. In the event of a lost package, no compensation may be granted before the result of an investigation by the carrier.
After a period of 30 days from the dispatch of your order, no complaints will be taken into account by the SARL.
5/ Payment
Payment for orders placed on the site: www.deliceslowcarb.com can be made by credit card for all products sold on said site.
The information transmitted allowing payment is encrypted by software securing the transaction; no third party will be able to view this data.
To be valid, any order must be paid in full, failing which, this will result in the cancellation of the delivery.
6/ Withdrawal
The Buyer does not have a withdrawal period except in the case of non-food products (specialist bookstore).
In fact, products that are perishable (those with a use-by date) (article L.221-28 of the consumer code) cannot benefit from the withdrawal period.
7/ Security
A data security system is installed on the site: SSL encryption allows the protection of sensitive banking data
Payment for orders is made via Banque Populaire.
8/ Intellectual property
All visuals, texts, photos, drawings, images, comments, visual or sound animations on the Site are subject to intellectual property rights and copyright and as such, any reproduction (exploitation, rebroadcast or any use whatsoever) is strictly prohibited, in part or in full.
9/ Customer service
Our customer service is at your entire disposal from Monday to Friday from 8 a.m. to 5:30 p.m.

10/ Responsibility:
All sugar-free products on the Site comply with current French legislation and the standards applicable in France.
The Buyer is invited to refer to the description of each product to know its characteristics (ingredients etc.). In case of doubt or if he wishes, he can contact Customer Service (9/). Indeed, the photos of the products are presented for information purposes only. They are not contractual and cannot engage the responsibility of our Company in the event of inaccuracies, omissions or errors in general.
11/ Legal guarantees of conformity
The Customer benefits from the legal guarantee of conformity of the goods and hidden defects provided for in the legal provisions of articles 1641 et seq. of the Civil Code.
As such, defective products or those not corresponding to those ordered may be subject to a refund or exchange under the following conditions: the products must be new, complete and in their original condition (accessories, packaging, etc.) accompanied by the original purchase invoice, it being understood that no product may benefit from this refund/exchange before reshipment and receipt of the products by the SARL. The right of withdrawal may, moreover, be exercised. (6/)
12/ Personal information
In order to enable the management of orders for sugar-free products placed by the Buyer and their smooth execution, personal information concerning the Buyer is necessary and may be transmitted to our order management, execution, processing and payment department.
The SARL reserves the right to collect this information including the use of cookies. In accordance with the Data Protection Act No. 78-17 of 06/01/78, the Customer has the right to access, rectify and delete personal data concerning him/her. To do this, he/she only has to write to our Company at the following address: 4 chemin de la Ménude 31770 Colomiers, specifying name/first name/e-mail and customer reference.
The automated collection and processing of this information has been authorized by the CNIL:

Cookies are stored in your computer's memory and have a permanent lifespan. If you wish, you can configure your computer to refuse these cookies. Similarly, when you place an order on our Site, your email address is used to track your order and is also used to send offers from our Company. The Buyer may at any time request to no longer receive information from REGIME CRETOIS.
13/ Applicable law in the event of a dispute
The French language in which these General Terms and Conditions are drawn up constitutes the sole language of the parties. In this sense, French law is the only applicable law and the Toulouse Commercial Court is the only competent one. An amicable solution must be sought as a priority, it being understood that good faith and the desire to find a solution are presumed for both parties.
